By accessing partsmunk.com and placing an order, you agree to be bound by these Terms of Service ("Terms"). By using our website, you confirm that you are at least 18 years of age and have the legal authority to enter into these Terms. If you do not agree, you may not use the Services.

1. Use of the Website

You may use our website for lawful purposes only. You agree not to:

• Violate any applicable law or regulation
• Attempt unauthorized access to any portion of the website or our systems
• Transmit harmful, fraudulent, or malicious content
• Use automated tools (scrapers, bots, crawlers) to access content without our prior written permission, except customary search engine indexing
• Interfere with the normal operation of the website

2. Product Information and Fitment

We make every effort to ensure product descriptions, images, pricing, and fitment information are accurate. Fitment information is provided as a guide only.

It is your responsibility to verify that any part you order is compatible with your specific vehicle, including Year, Make, Model, Trim, engine configuration, and OEM part number, before placing an order.

Installation should be performed by a qualified technician. Improper installation may void manufacturer warranties and can cause damage to your vehicle. PartsMunk is not responsible for vehicle damage, personal injury, or any other damages resulting from incorrect part selection, improper installation, or failure to follow manufacturer instructions.

Always confirm compatibility with your vehicle's OEM part number before purchasing.

3. Emissions, Off-Road, and Racing Products

Some products we sell are labeled or otherwise identified as:

• For off-road or competition use only — not legal for use on public roads in some jurisdictions
• Not legal for sale or use in California — may not comply with California Air Resources Board (CARB) regulations
• Emissions-related — must comply with applicable federal Environmental Protection Agency (EPA) and state regulations

It is your responsibility to ensure that any product you purchase is legal for use in your jurisdiction and for your intended application. PartsMunk does not warrant that any product is legal for street use in all jurisdictions. Products affecting emissions systems may void your vehicle's emissions warranty. Tuners, programmers, and ECU modifications may be subject to additional legal restrictions.

4. Pricing and Availability

All prices are in US dollars and subject to change without notice. We reserve the right to limit quantities, restrict sales to specific geographic regions, or refuse any order.

If a product is listed at an incorrect price due to a typographical error or an error in pricing information received from our suppliers, we reserve the right to cancel orders placed at the incorrect price. We will notify you by email if your order is cancelled for this reason.

Sales tax will be added to your order where required by law.

5. Payment

We accept Visa, Mastercard, American Express, Discover, PayPal, and Shop Pay. By submitting payment information, you confirm you are authorized to use the payment method provided. All transactions are processed securely through our payment provider. We reserve the right to refuse or cancel any order at our discretion.

6. Order Cancellations

Orders begin processing immediately upon placement. Contact support@partsmunk.com immediately if you need to cancel. If the order has already shipped, you must follow our Refund Policy.

7. Shipping and Returns

Shipping of your order is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. By placing an order, you agree to those policies.

8. Intellectual Property

All original content on partsmunk.com, including text, images, logos, and graphics created by PartsMunk, is the property of PartsMunk and protected by applicable intellectual property laws. You may not reproduce, modify, or distribute any such content without our prior written consent, except for fair use and customary search engine indexing.

Third-party trademarks, logos, product names, and product images referenced on our website are the property of their respective owners and are used only to identify their products. Use of third-party trademarks does not imply endorsement, authorization, or affiliation unless expressly stated.

9. User-Submitted Content and Reviews

If you submit reviews, comments, questions, or other content to our website, you grant PartsMunk a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, modify, publish, and display that content in connection with the operation of our business.

You represent that any content you submit is your own, does not violate the rights of any third party, and does not contain unlawful, obscene, defamatory, threatening, or offensive material. We reserve the right to moderate, edit, or remove user content at our sole discretion.

10. Electronic Communications Consent

By creating an account, placing an order, or subscribing to our communications, you consent to receive electronic communications from PartsMunk, including order confirmations, shipping notifications, customer support messages, and — if you opt in — marketing emails and text messages. You may opt out of marketing communications at any time by following the unsubscribe instructions in those messages or by contacting us.

11. California Proposition 65

Products we sell may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, California residents may visit www.p65warnings.ca.gov.

12. Limitation of Liability

To the maximum extent permitted by law, PartsMunk's total liability for any claim arising from or relating to these Terms, the Services, or any product purchased from PartsMunk is limited to the purchase price of the product(s) in question.

PartsMunk is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, vehicle damage, diminished vehicle value, loss of use, rental car costs, towing costs, labor charges, or personal injury arising from the use of our products or the Services, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

13. Disclaimer of Warranties

Except as expressly stated in our product warranty terms (see our Refund Policy), our website and products are provided "as-is" and "as-available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of content. We do not warrant that the Services will be uninterrupted, error-free, or secure.

14. Indemnification

You agree to indemnify, defend, and hold harmless PartsMunk, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of these Terms
• Your violation of any law or third-party right
• Any content you submit to the Services

15. Force Majeure

PartsMunk is not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions, labor disputes, supply chain disruptions, carrier delays, internet outages, or acts of war or terrorism.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.

Informal Resolution. Before filing any claim, you agree to first contact us at legal@partsmunk.com and attempt to resolve the dispute informally for a period of at least 30 days.

Binding Arbitration and Class Action Waiver. Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Services that cannot be resolved informally shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Orange County, Florida, unless otherwise agreed. You and PartsMunk agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative action. Class arbitration is not permitted.

Exceptions. Either party may bring claims in small claims court if they qualify, and either party may seek injunctive or equitable relief in court for claims relating to intellectual property.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@partsmunk.com within 30 days of first accepting these Terms.

Jurisdiction for Court Claims. For any claim not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Orange County, Florida.

17. Account Termination

We reserve the right to suspend or terminate your account and refuse future orders if we determine that you have violated these Terms, engaged in fraudulent activity, abused our return policy, or otherwise acted in bad faith.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and PartsMunk regarding the Services and supersede any prior agreements.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. The "Last updated" date at the top will reflect the most recent version. Your continued use of our website after changes are posted constitutes acceptance of the updated Terms.
